1. About DJ Yan
DJ Yan provides professional DJ entertainment, live percussion and additional live musicians for weddings, corporate events and private celebrations.
These Terms & Conditions set out the arrangements for booking our services and the responsibilities of both DJ Yan and the client.
Trading name: DJ Yan
Business owner: Yiannis Sachinis
Business address: 40 Massey Road, Devizes, Wiltshire, SN10 3UE
Email: djdrummeryan@gmail.com
Telephone: 07810 354 771
Website: www.djyan.co.uk
In these terms, "DJ Yan", "we", "us" and "our" refer to Yiannis Sachinis trading as DJ Yan. "Client", "you" and "your" refer to the person or organisation entering into the booking agreement.
These terms apply to bookings made directly with DJ Yan. Bookings arranged through third-party agencies or platforms may be governed by separate contractual arrangements.
2. Quotations and Booking Confirmation
All quotations are subject to availability and are based on the information supplied by the client.
A quotation does not reserve an event date or constitute a confirmed booking.
Unless otherwise specified, a quotation is valid for 14 days, subject to availability.
A booking is confirmed when:
-
The event details, services and total fee have been agreed.
-
The client has accepted the booking agreement and these Terms & Conditions.
-
The required booking deposit has been received.
-
DJ Yan has issued written confirmation of the booking.
Until the booking is confirmed, the date may be offered to other clients.
Any special requirements or agreed variations must be recorded in writing.
3. Booking Agreement and Contract Documents
Each confirmed booking will have an individual booking agreement or written confirmation specifying, as applicable:
-
Client name and contact details.
-
Event date and venue.
-
Event type.
-
Services and entertainment package.
-
Arrival, setup and performance times.
-
Equipment and production requirements.
-
Total fee, deposit and payment schedule.
-
Any agreed travel, parking, accommodation or additional charges.
-
Any other specific arrangements.
The booking agreement and these Terms & Conditions together form the contract between the parties.
Where a specifically negotiated term in the booking agreement conflicts with these general terms, the specifically negotiated term will take precedence, provided it is lawful.
No amendment will be binding unless agreed by both parties in writing.
4. Services and Entertainment
DJ Yan agrees to provide the services described in the confirmed booking agreement with reasonable care and skill.
Depending on the package booked, these may include:
-
Professional DJ entertainment.
-
Live percussion incorporated into the DJ performance.
-
Additional professional musicians, including saxophonists.
-
DJ equipment, sound systems and dancefloor lighting.
-
Wedding ceremony music and microphones.
-
Drinks reception entertainment.
-
Background music during dining.
-
Microphones and sound support for speeches.
-
Additional agreed performance hours.
Only services expressly included in the booking agreement are included in the agreed fee.
Additional services may be arranged subject to availability and an agreed additional charge.
Descriptions, photographs and videos on the website are illustrative of the entertainment offered. The precise services and equipment included in a booking will be those agreed in writing.
5. Fees, Deposits and Payment
Unless otherwise agreed, a deposit of 10% of the total booking fee is required to confirm the booking.
The remaining balance is payable no later than seven calendar days before the event.
For bookings made within seven days of the event, the full fee may be payable upon confirmation.
Payment is normally accepted by bank transfer.
All prices and any applicable taxes will be clearly identified in the quotation or booking agreement.
The client is responsible only for the charges agreed in advance, together with any additional charges subsequently authorised by the client.
If payment is overdue, DJ Yan will provide written notice and a reasonable opportunity to resolve the matter.
Where a material payment obligation remains unmet after reasonable notice, DJ Yan may suspend preparations or terminate the booking, subject to applicable law.
Any cancellation charge arising from such termination will be assessed in accordance with Section 15 rather than imposed automatically.
6. Performance Times and Duration
The agreed performance start and finish times will be specified in the booking agreement.
Performance duration refers to the contracted entertainment period and does not include setup, soundcheck or equipment removal unless expressly agreed.
Where the booking includes DJ entertainment throughout a specified period, DJ Yan will provide music during that period, allowing for reasonable operational breaks where necessary.
If the client or venue requests an earlier finish, the agreed booking fee will ordinarily remain payable, provided DJ Yan is ready, willing and able to deliver the contracted services.
Any reduction or refund will take account of the circumstances, including whether DJ Yan has failed to provide an agreed service or has avoided material costs.
The client must ensure that the venue permits entertainment during the contracted hours.
7. Additional Hours and Late Finishes
Requests to extend the performance beyond the agreed finish time are subject to availability and must be agreed with DJ Yan.
Additional performance time will be charged at the rate confirmed before the extension is accepted.
Extensions beyond midnight, or those resulting in an unusually late departure, may require overnight accommodation or additional travel arrangements.
Any additional accommodation, travel or parking costs will be agreed with the client before the extension is confirmed.
DJ Yan is not obliged to perform beyond the contracted finish time without agreement.
8. Travel, Parking and Accommodation
The agreed fee will include the travel arrangements expressly stated in the booking agreement.
Additional charges may apply where the event requires:
-
Significant travel outside the agreed area.
-
Parking fees or venue access charges.
-
Overnight accommodation.
-
Additional journeys or unusual transport arrangements.
-
Travel or accommodation for additional musicians.
These costs will be included in the quotation where known.
Any material additional costs arising from changes requested by the client will be discussed and agreed before being incurred.
DJ Yan will not impose unexpected travel or accommodation charges without the client's agreement, except where a lawful entitlement arises from the client's breach of contract.
9. Venue Access and Setup
The client agrees to arrange suitable access to the venue for loading, unloading, setting up and removing equipment.
Unless otherwise agreed, a minimum of 60 minutes should be available for setup and soundcheck.
More time may be required for larger sound systems, complex venue access or additional live musicians.
The client must ensure that the venue provides:
-
Adequate and safe performance space.
-
Suitable electrical power.
-
Reasonable access to loading and unloading areas.
-
Appropriate permissions for amplified entertainment.
-
A safe and accessible route for equipment.
-
Any relevant information about noise restrictions or venue requirements.
The client should notify DJ Yan in advance of stairs, long carrying distances, restricted access, limited parking or other circumstances that may materially affect setup.
Where delays arise because agreed access or facilities have not been provided, DJ Yan will make reasonable efforts to deliver the performance.
However, DJ Yan will not be required to extend the contracted finish time or provide additional services without agreement.
Any reasonable additional costs directly caused by the client's failure to provide agreed arrangements may be recoverable where legally justified.
10. Sound, Lighting and Third-Party Equipment
Unless otherwise specified, DJ Yan will provide the sound, lighting and DJ equipment included in the confirmed package.
Where a venue or third-party production company provides equipment, its suitability, compatibility and technical requirements must be agreed in advance.
DJ Yan may decline to use equipment that reasonably appears unsafe, defective or unsuitable.
If equipment supplied by a third party fails, DJ Yan will take reasonable steps to minimise disruption and provide the agreed services where practicable.
Responsibility for any failure will depend on its cause and the parties' respective contractual obligations.
Nothing in this section removes DJ Yan's responsibility to exercise reasonable care and skill when using, arranging or operating equipment.
11. Outdoor Events and Weather Protection
Outdoor performances must have suitable protection from rain, moisture, excessive wind, direct exposure to hazardous weather and other conditions that could endanger performers or equipment.
The client must arrange:
-
A stable, level and suitable performance area.
-
Safe electrical power appropriate for the location.
-
Adequate weather protection.
-
A suitable contingency arrangement where reasonably necessary.
DJ Yan may pause or decline to commence a performance where conditions present a genuine safety risk.
Where possible, the parties will work together to identify a safe alternative.
Any financial consequences will be assessed according to the circumstances, the parties' responsibilities and applicable law.
12. Client and Guest Responsibilities
The client agrees to take reasonable steps to ensure a safe environment for performers, guests and equipment.
Guests and venue personnel must not interfere with DJ equipment without permission.
The client may be responsible for reasonable repair or replacement costs arising from damage caused by the client or their guests through negligence or deliberate misconduct, where legally recoverable.
DJ Yan will take reasonable steps to secure and protect equipment, including appropriate stands, cable management and safe positioning.
The client is responsible for communicating relevant venue restrictions and safety requirements before the event.
13. Music Selection and Special Requests
DJ Yan will discuss the client's musical preferences, preferred genres and any specific requests before the event.
Reasonable efforts will be made to accommodate agreed preferences, including important songs for ceremonies, first dances or other scheduled moments.
The client should provide essential song requests and any prohibited songs sufficiently in advance.
DJ Yan retains professional discretion over the order, timing and mixing of music, taking account of the agreed brief and the atmosphere of the event.
Specific recordings may occasionally be unavailable due to technical, licensing or other practical limitations.
No particular level of audience participation, dancing or guest response can be guaranteed.
DJ Yan will nevertheless use reasonable care and skill to deliver the entertainment agreed.
14. Additional Musicians and Performers
Where a saxophonist, percussionist or other musician is included, the booking agreement will specify the relevant service and any agreed performance duration.
DJ Yan may engage suitable professional musicians to fulfil the booking.
Where a particular musician has been expressly agreed as essential to the booking, any proposed substitution will require the client's agreement.
If an additional musician becomes unavailable because of illness, emergency or another unforeseen circumstance, DJ Yan will make reasonable efforts to arrange a suitable replacement.
Any material substitution will be communicated to the client as soon as reasonably practicable.
Where an agreed service cannot be delivered, the client will be entitled to an appropriate refund or other remedy in accordance with the contract and applicable law.
DJ Yan remains responsible for services contracted directly through DJ Yan, including the performance of musicians engaged to deliver those services.
15. Client Cancellations
15.1 Written Notice
If the client wishes to cancel a confirmed booking, they should notify DJ Yan by email as soon as possible.
The cancellation date will normally be the date written notice is received.
A client who has clearly communicated cancellation will not lose statutory rights solely because notice was given by another legally valid method.
15.2 Reservation of the Event Date
Once a booking is confirmed, DJ Yan reserves the agreed date and performance period for the client.
DJ Yan may decline other work as a result of that commitment.
A cancellation may therefore cause financial loss, including reasonable preparation expenses, unavoidable supplier commitments and lost profit where the reserved date cannot reasonably be filled.
15.3 Booking Deposit
The 10% booking deposit forms part of the total booking fee.
If the client cancels, some or all of the deposit may be retained to cover reasonable losses directly arising from the cancellation.
The deposit is not automatically non-refundable.
Any amount retained will be credited towards the total cancellation charge and will not be charged twice.
15.4 Cancellation Charges
The following schedule indicates the maximum cancellation charges that may apply according to the notice given:
Notice before eventMaximum indicative charge
More than 90 days10% of total booking fee
60 to 90 days32.5% of total booking fee
30 to 59 days55% of total booking fee
Less than 30 daysUp to 100% of total booking fee
These percentages are maximum indicative amounts, not automatic penalties or guaranteed minimum charges.
The actual cancellation charge will be limited to a fair and reasonable assessment of losses directly resulting from the cancellation.
Relevant factors include:
-
Reasonable expenses already incurred.
-
Unavoidable commitments to additional musicians or suppliers.
-
Lost profit from the cancelled booking.
-
The likelihood of securing replacement work.
-
Any replacement work actually secured.
-
Costs avoided because the event will no longer take place.
-
Reasonable steps taken to minimise financial loss.
Lost profit and incurred costs will be calculated without double-counting the same loss.
DJ Yan will not charge more than the reasonable loss attributable to the cancellation or the applicable indicative maximum.
15.5 Replacement Bookings
DJ Yan will take reasonable steps to minimise losses arising from cancellation.
Where replacement work is secured for the same date and performance period, the cancellation charge will be reassessed to reflect any earnings recovered and any remaining reasonable losses.
The client will not be charged for losses that have been avoided or recovered.
15.6 Refunds and Outstanding Charges
Deposits and other payments already received will be credited towards the final cancellation charge.
Any amount paid in excess of the reasonable cancellation charge will be refunded.
If the reasonable charge exceeds payments already made, DJ Yan may request the outstanding amount, subject to the applicable maximum and the client's legal rights.
A reasonable explanation of the calculation will be provided upon request.
Any refund due will normally be processed within 14 days of the amount being determined, without unreasonable delay.
15.7 Third-Party Costs
Where additional musicians or services have been arranged specifically for the event, unavoidable and reasonable cancellation costs may be taken into account.
Any refunds, savings or recoveries from suppliers will also be taken into account.
The client will not be charged twice for the same loss.
15.8 Statutory Rights
Nothing in this section excludes or limits the client's statutory rights.
The cancellation schedule will not override any legal entitlement to cancel without charge or any remedies arising from DJ Yan's breach of contract.
16. Postponements and Changes of Date
Requests to postpone or reschedule an event must be made in writing.
DJ Yan will make reasonable efforts to accommodate an alternative date where available.
A postponement is not automatically guaranteed.
Where a new date is agreed, the parties will confirm in writing:
-
The revised event date and venue.
-
Any changes to the services.
-
Any additional or reduced costs.
-
How payments already received will be applied.
-
Any revised payment deadlines.
Where a proposed new date is unavailable, or no alternative can be agreed, the original booking may need to be cancelled.
Any cancellation charge will be assessed under Section 15, taking account of reasonable losses and costs avoided.
DJ Yan will not impose an arbitrary postponement penalty.
17. Cancellation or Non-Performance by DJ Yan
If DJ Yan becomes unable to fulfil a confirmed booking because of illness, emergency or another serious unforeseen circumstance, the client will be informed as soon as reasonably practicable.
Reasonable efforts will be made to arrange a suitable professional replacement.
Where a replacement would materially change the agreed services or performer, the client's agreement will be sought.
If no suitable replacement is agreed and the contracted services cannot be provided, payments for the undelivered services will be refunded.
Any additional legal rights or remedies available to the client will remain unaffected.
DJ Yan will not be entitled to retain payment for services not delivered where doing so would be unlawful or unfair.
18. Events Beyond Reasonable Control
Circumstances outside the reasonable control of either party may include severe weather, major transport disruption, serious emergencies, government restrictions or unexpected venue closure.
A party affected by such circumstances must notify the other as soon as reasonably practicable and take reasonable steps to minimise disruption.
Where possible, the parties will explore practical alternatives, including postponement or modified arrangements.
Any refund, additional payment or cancellation charge will be determined fairly, taking account of:
-
The services already provided.
-
The reason performance became impossible or impracticable.
-
Costs reasonably incurred.
-
Costs avoided or recoverable.
-
Applicable law and statutory rights.
This section does not automatically entitle either party to retain all payments or avoid all responsibility.
19. Safety, Conduct and Right to Stop Performance
DJ Yan reserves the right to pause or stop a performance where there is a genuine and significant risk to personal safety or equipment.
Examples may include:
-
Threatening or violent behaviour.
-
Serious harassment or abuse.
-
Unsafe electrical installations.
-
Dangerous interference with equipment.
-
Unsafe venue or weather conditions.
Where reasonably possible, DJ Yan will notify the client or event organiser and allow an opportunity for the issue to be resolved.
Any decision to stop performing will be proportionate to the circumstances.
The financial consequences will depend on the cause of the problem, the parties' responsibilities and applicable law.
20. Venue Restrictions and Licensing
The client is responsible for arranging appropriate venue permissions and informing DJ Yan of relevant restrictions.
These may include:
-
Permitted entertainment hours.
-
Sound-level limits.
-
Noise-management requirements.
-
Venue access and loading restrictions.
-
Relevant permissions or licences for the event.
DJ Yan will comply with lawful and reasonable venue requirements communicated in advance.
Where a restriction prevents delivery of the agreed services, the parties will seek a reasonable solution.
Responsibility for any resulting loss will depend on the cause and the terms agreed.
21. Changes to the Event
The client must notify DJ Yan as soon as reasonably possible of any material changes to the event.
These may include changes to:
-
Venue or event location.
-
Performance times.
-
Access arrangements.
-
Guest numbers where relevant to production.
-
Entertainment requirements.
-
Sound or lighting arrangements.
Changes may affect availability, equipment requirements or costs.
DJ Yan will explain any necessary price adjustment and obtain the client's agreement before implementing a material change.
DJ Yan will not unilaterally increase the agreed price merely because operating costs have changed.
22. Photography, Video and Publicity
DJ Yan may occasionally capture photographs or video footage during performances.
Any promotional use of identifiable footage will be subject to an appropriate lawful basis and applicable privacy rights.
The client may notify DJ Yan of reasonable privacy, confidentiality or filming restrictions before the event.
DJ Yan will respect any agreed restrictions, including those relating to private or high-profile events.
This clause does not require clients or guests to consent to promotional photography or video.
23. Personal Information and Privacy
Personal information collected during enquiries and bookings will be processed in accordance with applicable UK data protection law.
Information may be shared with venues, musicians and other relevant suppliers where reasonably necessary to deliver the contracted services.
Further information is available in our Privacy Policy.
24. Liability and Consumer Rights
DJ Yan will provide the contracted services with reasonable care and skill.
Responsibility for any loss, damage or failure will be assessed according to the circumstances and applicable law.
DJ Yan will not be responsible for failures caused solely by third parties or events outside DJ Yan's reasonable control where no legal responsibility arises.
Nothing in these terms excludes or restricts liability for:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of statutory consumer rights.
-
Any other liability that cannot lawfully be excluded or limited.
Where services are not performed with reasonable care and skill, the client retains any statutory rights to repeat performance, a price reduction or other applicable remedies.
25. Complaints and Dispute Resolution
If the client has a concern about the services provided, they should contact DJ Yan as soon as reasonably possible.
Where practical, concerns raised during an event will be addressed at the time.
Formal complaints may be submitted by email to djdrummeryan@gmail.com.
DJ Yan will acknowledge complaints within a reasonable period and aim to provide a substantive response within 14 days, or explain if further investigation is required.
Both parties agree to make reasonable efforts to resolve disputes through discussion before commencing formal proceedings.
Nothing in this section prevents either party from exercising legal rights or seeking legal remedies.
26. Website Information and Pricing
Information published on the DJ Yan website is intended to provide a general overview of our services.
Published prices, packages and availability may change before a booking is confirmed.
Once a booking has been confirmed, the agreed price and services will not be changed unilaterally.
Website content, including photographs, videos and written descriptions, remains subject to applicable intellectual property rights.
27. Changes to These Terms
DJ Yan may update these website Terms & Conditions from time to time.
The version accepted when a booking is confirmed will ordinarily apply to that booking.
Subsequent changes will not automatically alter an existing contract.
Any proposed changes to a confirmed booking must be agreed by both parties, except where applicable law requires otherwise.
28. Governing Law
These Terms & Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply.
Nothing in these terms restricts a consumer's right to bring proceedings in a court that has jurisdiction under applicable law.
